is it really FOSS?

Issues exist
There's FOSS code here, but there's issues around licensing, marketing, or transparency.

Details

The project is provided under a AGPLv3 mixed license, which presents compatibility issues by itself.

The readme mentions the license being AGPLv3 without making the extra licenses involved clear.

The AGPLv3 code problematically appears to rely on the non-FOSS code, resulting in the application not working as-provided using FOSS code alone.

The readme is misleading in regards to the requirements of the AGPLv3, stating:

Clone the repo into a public GitHub repository (or fork https://github.com/calcom/cal.com/fork). If you plan to distribute the code, keep the source code public to comply with AGPLv3. To clone in a private repository, acquire a commercial license

This is while the ability to simply clone to a private repository is well within the AGPLv3 (and any FOSS license) terms.

Many of these issues have been raised 1, 2, [3] with responses showing deflection and little indication of improvement.

The project has raised at least $32.4m of funding from investors including Seven Seven Six, OSS Capital, Obvious Ventures and Daily.co.
