The project is provided under a BSD 3-Clause license.

This FOSS license is specific to the “Conda” community project. Since it’s provided under a permissive license, other variants and distributions (such as Miniconda and Anaconda for example) may be using/including/distributing Conda under non-FOSS terms.

The project is managed by the Conda Organization, which has open governance. This appears to have some level of limits on organization control:

No more than 2 council members can have the same funder: Each Steering Council member can have the same funding organization as at most one other Council member.

And, from looking at the steering members at the time of review, this appears to be followed.

Conda still shows some signs of its Anaconda roots, with the license currently reflecting the copyright of “Copyright (c) 2012, Anaconda, Inc.”, and with US Conda trademarks (1, 2) being owned by “ANACONDA, INC.”. Conda’s governance states:

Community Projects need to license/assign the project’s trademarks when becoming a conda Organization Community Project. This is an act of good faith and communicates to the community that the project is committed to our overall efforts.

1. Trademarks are irrevocably licensed or transferred to the conda Organization’s fiscal sponsor when a project is added to the conda Organization as a Community Project. […]

As of writing the project’s homepage states:

conda is a fiscally sponsored project of NumFOCUS.

So it could be assumed the trademarks have been licensed to NumFOCUS by ANACONDA, INC. although this is not fully confirmed as far as we could see.

The project appears to be funded by donations, and receives infrastructure and developer support from several tech companies, including Anaconda.
