is it really FOSS?

There's FOSS code here, but there's issues around licensing, marketing, or transparency.

Details

The project is licensed under the AGPLv3 mixed with a custom non-open enterprise license.

At point of review, there did appear to be at least once case of open code relying on non-open code. This was minimal though and their introduction of mixed licenses was new at time of review.

It does look like a lot of existing open features were moved to be under the non-open license.

The project refers to itself as open source on its website and project readme.

The project used to misrepresent the AGPLv3 license although this was quickly addressed when raised.

The project does appear to request a CLA to be signed on contribution but the earliest example found is from 2024, so it’s not externally clear if prior contributor rights have been gained.

The project has raised at least $2m in funding with investors including OSS Capital, Vercel CEO Guillermo Rauch, Balaji Srinivasan, Jorn van Dijk and Koen Bok, former Facebook designer Soleio, Perplexity, Figma, and Cal.com Chairman Peer Richelsen. It also appears to gain revenue from providing their software as a service and paid variations.
