The FOSS code appears to rely on the non-FOSS licensed code.
The project advertises as open source on its homepage (with over 10 references in count), in addition to in its GitHub description and within its project readme.
The main docker image provided, when following self-hosted guidance for this application advertised as open source, appears to provide a version with the enterprise code included and used.
These issues were queried on Reddit, with responses from the author, but these issues have persisted since.
The project also appears to have a potentially misleading CLA, with it providing a “In simple terms” section at the top stating:
✅ Your code gets published under the open source AGPL license and will always be available to the community. ✅ With this agreement we make sure that Formbricks is built on a solid legal foundation. This allows us to maintain the project in the coming decades.
But this summary omits to mention many of the rights a user is providing by signing the CLA, and may be misguiding since their license does not assure it remains available to the community under the AGPL, as the CLA terms specifically allow formbricks to act far beyond this.
Formbricks has received funding from OSS Capital, Peer Richelsen (co-founder at Cal.com), as well as being part of the initial GitHub Accelerator. The project also appears to receive revenue from providing the software as a service, in addition to paid variations of its software.
